Terms of Service
The rules and conditions for using Selekta.
Acceptance of Terms
By accessing or using Selekta, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. We may update these terms at any time; continued use after changes constitutes acceptance.
Platform Fee
Selekta charges a 15% platform fee on all tips processed through the platform. This fee is deducted before funds are credited to the artist's available balance. Boost payments are separate and are not subject to the platform fee. All fees are exclusive of any applicable taxes.
Artist Obligations
Artists must provide accurate M-Pesa numbers for payouts. You are responsible for configuring your event correctly, including request types, tip minimums, and band member splits. Withdrawals are processed via M-Pesa B2C and may take up to 48 hours to reflect. Artists are responsible for any taxes owed on earnings received through the platform.
Artist Assistant
The Artist Assistant can help prepare event details, explain account information, organise request types, and suggest event changes. Assistant output may be incomplete or inaccurate and does not replace your judgment. You are responsible for checking dates, times, venues, prices, request caps, and other details before approving an action. A suggested action is not applied until you explicitly approve it. You must not use the assistant to create misleading, unlawful, abusive, or fraudulent content.
Poster Uploads and Event Details
Artists may upload an event poster to help prepare an event draft. You confirm that you have the right to upload and use the image and that it does not contain unlawful, infringing, or sensitive information. Automated extraction can misread a poster, especially partial dates, times, names, or locations. You must review and correct the draft before approval. An uploaded poster does not publish an event by itself.
Request Caps and Event Controls
Artists are responsible for configuring request types, minimum tips, request caps, event status, and content requirements. A blank request cap means unlimited requests for that type where the event settings allow it. Artists remain responsible for moderating requests and deciding which requests to play, pin, decline, or remove.
Fan Conduct
Fans agree not to submit abusive, illegal, or fraudulent request content. Tips are non-refundable once processed. The artist retains sole discretion over which requests to play, pin, or decline. Fans must be 18 years or older to use the platform.
Acceptable Use
You may not use Selekta to impersonate another person, manipulate tips or rankings, upload content without permission, submit abusive or illegal requests, interfere with platform security, or attempt to bypass approval, rate limits, payment controls, or other safeguards. We may suspend access while investigating suspected misuse.
Limitation of Liability
Selekta is provided "as is" without warranties of any kind. We are not liable for damages arising from use of the platform, including but not limited to service interruptions, payment processing delays, or artist-fan disputes. Our total liability is limited to the amount of platform fees paid in the 12 months preceding the claim.
Termination
Either party may terminate the agreement at any time. Artists may delete their account via settings; fans may stop using the platform at any time. We reserve the right to suspend or terminate accounts that violate these terms.
Governing Law
These terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
